  1.1                          A bill for an act 
  1.2             relating to liquor; modifying restrictions on 
  1.3             importers of wine; prohibiting certain exclusive 
  1.4             agreements in the sale of wine; amending Minnesota 
  1.5             Statutes 2002, section 340A.307, subdivision 4, by 
  1.6             adding a subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 340A.307, 
  1.9   subdivision 4, is amended to read: 
  1.10     Subd. 4.  [EXCEPTIONS.] Nothing in this section applies to: 
  1.11     (1) wine or malt liquor of any alcohol content; 
  1.12     (2) intoxicating liquor which is:  
  1.13     (i) further distilled, refined, rectified, or blended 
  1.14  within the state; and 
  1.15     (ii) bottled within the state and labeled with the 
  1.16  importer's own labels after importation into the state; or 
  1.17     (3) any brand of intoxicating liquor which is offered for 
  1.18  sale only in this state.  No such brand shall vary from an 
  1.19  existing or new brand sold in another state in any manner as to 
  1.20  brand name, age, or proof of the product. 
  1.21     Sec. 2.  Minnesota Statutes 2002, section 340A.307, is 
  1.22  amended by adding a subdivision to read: 
  1.23     Subd. 5.  [ELIMINATION OF WINE WHOLESALE EXCLUSIVE 
  1.24  AGREEMENTS.] Notwithstanding any other law to the contrary, no 
  1.25  licensed wholesaler or manufacturer shall be a party to an 
  1.26  agreement with a licensed importer for the purchase of a brand 
  2.1   of wine by the licensed wholesaler or manufacturer to the 
  2.2   exclusion of the purchase of that brand by other licensed 
  2.3   wholesalers or manufacturers in the state after the effective 
  2.4   date of this act.
