A bill for an act
relating to public safety; requiring registered predatory offenders while on
supervised or conditional release to attend only chemical abuse treatment groups
that do not include members of the same gender as their victims; amending
Minnesota Statutes 2004, section 244.05, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 244.05, is amended by adding a
subdivision to read:

new text begin Predatory offender substance abuse treatment restrictions. new text end

new text begin When a
judge sentences an offender who is required to register as a predatory offender under
section 243.166, the judge must order that the offender, while on any form of supervised
or conditional release, not attend alcohol or chemical substance abuse treatment groups
that include persons of the same gender as the offender's victim. If the offender has both
male and female victims, the judge shall specify which type of substance abuse treatment
group the offender may participate in based on the needs of public safety. The agency
responsible for supervising the offender must confirm that the offender is complying
with this subdivision. If an offender attends a treatment support group in violation of the
court's order, the offender has violated the terms of the offender's supervised release. The
commissioner is not required to pay for an offender's alcohol or chemical substance
abuse treatment.
