  1.1                          A bill for an act 
  1.2             relating to human services; modifying the MFIP 
  1.3             consolidated fund; amending Minnesota Statutes 2003 
  1.4             Supplement, section 256J.626, subdivision 6. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2003 Supplement, section 
  1.7   256J.626, subdivision 6, is amended to read: 
  1.8      Subd. 6.  [BASE ALLOCATION TO COUNTIES AND TRIBES.] (a) For 
  1.9   purposes of this section, the following terms have the meanings 
  1.10  given them: 
  1.11     (1) "2002 historic spending base" means the commissioner's 
  1.12  determination of the sum of the reimbursement related to fiscal 
  1.13  year 2002 of county or tribal agency expenditures for the base 
  1.14  programs listed in clause (4), items (i) through (iv), and 
  1.15  earnings related to calendar year 2002 in the base program 
  1.16  listed in clause (4), item (v), and the amount of spending in 
  1.17  fiscal year 2002 in the base program listed in clause (4), item 
  1.18  (vi), issued to or on behalf of persons residing in the county 
  1.19  or tribal service delivery area. 
  1.20     (2) "Initial allocation" means the amount potentially 
  1.21  available to each county or tribe based on the formula in 
  1.22  paragraphs (b) through (d). 
  1.23     (3) "Final allocation" means the amount available to each 
  1.24  county or tribe based on the formula in paragraphs (b) through 
  1.25  (d), after adjustment by subdivision 7. 
  2.1      (4) "Base programs" means the: 
  2.2      (i) MFIP employment and training services under Minnesota 
  2.3   Statutes 2002, section 256J.62, subdivision 1, in effect June 
  2.4   30, 2002; 
  2.5      (ii) bilingual employment and training services to refugees 
  2.6   under Minnesota Statutes 2002, section 256J.62, subdivision 6, 
  2.7   in effect June 30, 2002; 
  2.8      (iii) work literacy language programs under Minnesota 
  2.9   Statutes 2002, section 256J.62, subdivision 7, in effect June 
  2.10  30, 2002; 
  2.11     (iv) supported work program authorized in Laws 2001, First 
  2.12  Special Session chapter 9, article 17, section 2, in effect June 
  2.13  30, 2002; 
  2.14     (v) administrative aid program under section 256J.76 in 
  2.15  effect December 31, 2002; and 
  2.16     (vi) emergency assistance program under Minnesota Statutes 
  2.17  2002, section 256J.48, in effect June 30, 2002. 
  2.18     (b)(1) Beginning July 1, 2003, the commissioner shall 
  2.19  determine the initial allocation of funds available under this 
  2.20  section according to clause (2). 
  2.21     (2) All of the funds available for the period beginning 
  2.22  July 1, 2003, and ending December 31, 2004, shall be allocated 
  2.23  to each county or tribe in proportion to the county's or tribe's 
  2.24  share of the statewide 2002 historic spending base. 
  2.25     (c) For calendar year 2005, the commissioner shall 
  2.26  determine the initial allocation of funds to be made available 
  2.27  under this section in proportion to the county or tribe's 
  2.28  initial allocation for the period of July 1, 2003, to December 
  2.29  31, 2004. 
  2.30     (d) The formula under this subdivision sunsets December 31, 
  2.31  2005. 
  2.32     (e) Before November 30, 2003, a county or tribe may ask for 
  2.33  a review of the commissioner's determination of the historic 
  2.34  base spending when the county or tribe believes the 2002 
  2.35  information was inaccurate or incomplete.  By January 1, 2004, 
  2.36  the commissioner must adjust that county's or tribe's base when 
  3.1   the commissioner has determined that inaccurate or incomplete 
  3.2   information was used to develop that base.  The commissioner 
  3.3   shall adjust each county's or tribe's initial allocation under 
  3.4   paragraph (c) and final allocation under subdivision 7 to 
  3.5   reflect the base change. 
  3.6      (f) Effective January 1, 2005 2006, counties and tribes 
  3.7   will have their final allocations adjusted based on the 
  3.8   performance provisions of subdivision 7.
