A bill for an act
relating to health; exempting pools that are owned and operated by a private
organization from the definition of a public pool; amending Minnesota Statutes
2008, section 144.1222, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 144.1222, is amended by adding a
subdivision to read:

new text begin Swimming pools owned and operated by a private organization. new text end

pool that is located outside on private property that meets the following requirements shall
be considered a private residential pool for the purposes of this section, section 157.16,
and Minnesota Rules, chapter 4717:

new text begin (1) the pool is owned and operated by a private organization that is organized as
a corporation;
new text end

new text begin (2) the use of the pool is limited to members of the organization and the members'
invited guests;
new text end

new text begin (3) the members must pay an initial membership fee to join the organization and an
annual fee to use the pool; and

new text begin (4) no more than 20 families may use the pool during a season.
