relating to education; creating vaping prevention pilot grants; appropriating money.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

appropriated from the general fund to the Department of Education in the fiscal year
designated.

(a) For grants to school districts for vaping
prevention programs.

(b) The commissioner of education must award grants to school districts to develop and
implement vaping prevention programs. "Vaping" as used in this section means using an
activated electronic delivery device, as defined in section 609.685, subdivision 1, or heated
tobacco product. A school district that applies for a vaping prevention pilot grant must
include in its application an explanation of how the district will measure outcomes. The
commissioner must award grants to an equal number of districts inside and outside the
seven-county metropolitan area and must prioritize grants for school districts that:

(1) demonstrate they have been unable to obtain funding from third parties to develop
and implement vaping prevention programs; and

(2) propose programs that can be replicated in other school districts.

(c) Grant funds must be used to develop and implement vaping prevention programs
using evidence-based research, and to develop alternatives to suspension for students who
are found vaping in violation of a school policy.

(d) A school district that receives a grant under this section must report to the
commissioner by January 15, 2021, on program development, implementation, and program
evaluation results, and must provide to the commissioner vaping prevention materials that
were developed using grant funds that school districts throughout Minnesota may use. The
commissioner must post the school district reports and vaping prevention materials on the
Department of Education website.
