  1.1                          A bill for an act 
  1.2             relating to education; reallocating appropriations to 
  1.3             provide funding in fiscal year 2001 for 
  1.4             telecommunication access grants; amending Laws 1999, 
  1.5             chapter 241, articles 4, section 27, subdivision 7; 
  1.6             and 10, section 5, subdivisions 2 and 4. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Laws 1999, chapter 241, article 4, section 27, 
  1.9   subdivision 7, is amended to read: 
  1.10     Subd. 7.  [TELECOMMUNICATION ACCESS GRANTS.] (a) For 
  1.11  telecommunication access grants according to Minnesota Statutes, 
  1.12  section 125B.20: 
  1.13       $5,000,000     .....     2000 
  1.14       $5,000,000     .....     2001 
  1.15     (b) Any balance in the first year does not cancel but is 
  1.16  available in the second year.  This amount shall not be included 
  1.17  as part of the base for fiscal year 2002-2003. 
  1.18     Sec. 2.  Laws 1999, chapter 241, article 10, section 5, 
  1.19  subdivision 2, is amended to read: 
  1.20     Subd. 2.  [TEACHING AND LEARNING PROGRAM.] (a) For the 
  1.21  teaching and learning program in the department of children, 
  1.22  families, and learning: 
  1.23       $9,979,000     .....     2000 
  1.24       $9,926,000 $7,426,000    .....     2001 
  1.25     (b) Any balance the first year does not cancel but is 
  1.26  available in the second year. 
  2.1      (c) $21,000 each year is from the trunk highway fund. 
  2.2      (d) $673,000 in 2000 and $678,000 in 2001 is for the board 
  2.3   of teaching. 
  2.4      (e) Notwithstanding Minnesota Statutes, section 15.53, 
  2.5   subdivision 2, the commissioner of children, families, and 
  2.6   learning may contract with a school district for a period no 
  2.7   longer than five consecutive years to work in the development or 
  2.8   implementation of the graduation rule.  The commissioner may 
  2.9   contract for services and expertise as necessary.  The contracts 
  2.10  are not subject to Minnesota Statutes, section 16B.06. 
  2.11     (f) American Indian language and culture programs, gifted 
  2.12  and talented programs, advanced placement and international 
  2.13  baccalaureate programs, Minnesota academic excellence foundation 
  2.14  programs, and SciMath Minnesota shall remain unaffected by the 
  2.15  reduction in the fiscal year 2001 appropriation. 
  2.16     Sec. 3.  Laws 1999, chapter 241, article 10, section 5, 
  2.17  subdivision 4, is amended to read: 
  2.18     Subd. 4.  [MANAGEMENT AND SUPPORT SERVICES PROGRAM.] (a) 
  2.19  For the management and support services program in the 
  2.20  department of children, families, and learning: 
  2.21      $16,987,000     .....     2000 
  2.22      $14,421,000 $11,921,000    .....     2001 
  2.23     (b) Any balance the first year does not cancel but is 
  2.24  available in the second year. 
  2.25     (c) $165,000 in 2000 is for the state board of education.  
  2.26  Any functions of the state board of education that are not 
  2.27  specifically transferred to another agency are transferred to 
  2.28  the department of children, families, and learning under 
  2.29  Minnesota Statutes, section 15.039.  For the position that is 
  2.30  classified, upon transferring the responsibilities, the current 
  2.31  incumbent is appointed to the classified position without exam 
  2.32  or probationary period. 
  2.33     (d) $2,000,000 in 2000 is for litigation costs and may only 
  2.34  be used for those purposes.  This is a one-time appropriation. 
  2.35     Sec. 4.  [EFFECTIVE DATE.] 
  2.36     Sections 1 to 3 are effective July 1, 2000.
