  1.1                          A bill for an act 
  1.2             relating to school board elections; Special School 
  1.3             District No. 1; providing for a board of 13 members to 
  1.4             be elected to staggered terms by district; amending 
  1.5             Minnesota Statutes 2002, section 128D.05, subdivision 
  1.6             1; by adding subdivisions. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 128D.05, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [NUMBER, TERM, PAY.] (a) The board of 
  1.11  education of such district shall consist of seven 13 directors.  
  1.12  The term of office of each director shall be four years or until 
  1.13  a successor is elected and qualified.  The directors shall 
  1.14  receive such compensation as may be fixed by the board of 
  1.15  education. 
  1.16     (b) The governing body of Special School District No. 1 may 
  1.17  provide for election of four of its directors in 1994 and 
  1.18  subsequent years for four-year terms, and election of three of 
  1.19  its directors in 1996 and subsequent years for four-year terms.  
  1.20  To accomplish this change, the governing body may provide that 
  1.21  the terms of office for directors elected in 1991 will expire 
  1.22  January 1, 1995, and that the terms of office for directors to 
  1.23  be elected in 1993 will expire January 1, 1997. 
  1.24     Sec. 2.  Minnesota Statutes 2002, section 128D.05, is 
  1.25  amended by adding a subdivision to read: 
  1.26     Subd. 1a.  [ELECTION DISTRICT BOUNDARIES.] The school board 
  2.1   shall designate each election district by number.  The territory 
  2.2   in each school election district shall consist of the territory 
  2.3   included in a corresponding city ward. 
  2.4      Sec. 3.  Minnesota Statutes 2002, section 128D.05, is 
  2.5   amended by adding a subdivision to read: 
  2.6      Subd. 1b.  [BOARD ELECTIONS.] A candidate for school board 
  2.7   at the elections in 2006 and thereafter must file an affidavit 
  2.8   of candidacy to be elected as a school board member for the 
  2.9   election district where the candidate resides.  A candidate must 
  2.10  indicate on the affidavit the number of the district from which 
  2.11  the candidate seeks election. 
  2.12     Sec. 4.  Minnesota Statutes 2002, section 128D.05, is 
  2.13  amended by adding a subdivision to read: 
  2.14     Subd. 1c.  [TRANSITION.] All school board members must seek 
  2.15  election in 2006.  In order to retain staggered elections, in 
  2.16  2006 individuals elected to odd-numbered seats will serve a 
  2.17  four-year term and individuals elected to even-numbered seats 
  2.18  will serve a two-year term.  
  2.19     Sec. 5.  [LOCAL APPROVAL.] 
  2.20     Section 1 is effective the day after the school board of 
  2.21  Special School District No. 1 and its clerk timely file their 
  2.22  compliance with Minnesota Statutes, section 645.021, 
  2.23  subdivisions 2 and 3.
