A bill for an act
relating to health; requiring the Board of Dentistry to adopt rules with detailed
infection control requirements; amending Minnesota Statutes 2020, section
150A.04, by adding a subdivision; repealing Minnesota Rules, part 3100.6300,
subpart 11.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 150A.04, is amended by adding a subdivision
to read:

new text begin (a) The board shall adopt rules to establish specific,
detailed infection control requirements for dentists, dental therapists, dental hygienists,
dental assistants, and dental technicians.

new text begin (b) Rules adopted under this subdivision must not require dentists, dental therapists,
dental hygienists, dental assistants, and dental technicians to comply with the infection
control recommendations, guidelines, precautions, procedures, practices, strategies, or
techniques established by another federal agency, state agency, or other organization, by
reference to any such agency or organization or to infection control recommendations of
any such agency or organization.

new text begin (c) Federal agencies, state agencies, and other organizations referenced in paragraph (b)
include but are not limited to the Minnesota Department of Health; United States Department
of Health and Human Services, Public Health Service; or Centers for Disease Control and
Prevention.

new text begin (d) The board shall adopt rules under this subdivision using the expedited process in
section 14.389, and section 14.389, subdivision 5, applies.

Subp. 11.

Infection control.

Dental health care personnel shall comply with the most current infection control recommendations, guidelines, precautions, procedures, practices, strategies, and techniques specified by the United States Department of Health and Human Services, Public Health Service, and the Centers for Disease Control and Prevention. Infection control standards are subject to frequent change.
