  1.1                          A bill for an act 
  1.2             relating to retirement; general employees retirement 
  1.3             plan of the Public Employees Retirement Association; 
  1.4             authorizing the conversion of a retirement annuity to 
  1.5             a disability benefit. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [PERA-GENERAL; RESCISSION OF AN ANNUITY 
  1.8   APPLICATION IN FAVOR OF A DISABILITY BENEFIT APPLICATION.] 
  1.9      (a) Notwithstanding Minnesota Statutes, section 353.29, 
  1.10  subdivision 7, or any other law to the contrary, an eligible 
  1.11  person described in paragraph (b) may revoke an application for 
  1.12  a retirement annuity from the general employees retirement plan 
  1.13  of the Public Employees Retirement Association and may file an 
  1.14  application for a disability benefit from the general employees 
  1.15  retirement plan of the Public Employees Retirement Association, 
  1.16  which will be effective on the first day of the month next 
  1.17  following the approval of the disability application under 
  1.18  Minnesota Statutes, section 353.33, subdivisions 2 and 4.  
  1.19     (b) An eligible person is a person who: 
  1.20     (1) has a Class A wastewater facility license from the 
  1.21  state of Florida; 
  1.22     (2) has a Class A wastewater facility license from the 
  1.23  state of Minnesota; 
  1.24     (3) was first employed by the Alexandria Lake Area Sanitary 
  1.25  District in December 1978; 
  2.1      (4) terminated employment as the chief treatment plan 
  2.2   operator by the Alexandria Lake Area Sanitary District on March 
  2.3   30, 2001; and 
  2.4      (5) filed for a retirement annuity from the general 
  2.5   employees retirement plan of the Public Employees Retirement 
  2.6   Association in March 2001 and began receipt of the retirement 
  2.7   annuity in May 2001.  
  2.8      Sec. 2.  [EFFECTIVE DATE.] 
  2.9      Section 1 is effective the day following final enactment.
