  1.1                          A bill for an act 
  1.2             relating to human services; providing a rate increase 
  1.3             for a certain hospital; appropriating money; amending 
  1.4             Minnesota Statutes 2000, section 256B.31. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2000, section 256B.31, is 
  1.7   amended to read: 
  1.8      256B.31 [CONTINUED HOSPITAL CARE FOR LONG-TERM POLIO 
  1.9   PATIENT.] 
  1.10     (a) A medical assistance recipient who has been a polio 
  1.11  patient in an acute care hospital for a period of not less than 
  1.12  25 consecutive years is eligible to continue receiving hospital 
  1.13  care, whether or not the care is medically necessary for 
  1.14  purposes of federal reimbursement.  The cost of continued 
  1.15  hospital care not reimbursable by the federal government must be 
  1.16  paid with state money allocated for the medical assistance 
  1.17  program.  The rate paid to the hospital is the rate per day 
  1.18  established using Medicare principles for the hospital's fiscal 
  1.19  year ending December 31, 1981, adjusted each year by the annual 
  1.20  hospital cost index established under section 256.969, 
  1.21  subdivision 1, or by other limits in effect at the time of the 
  1.22  adjustment.  This section does not prohibit a voluntary move to 
  1.23  another living arrangement by a recipient whose care is 
  1.24  reimbursed under this section. 
  1.25     (b) Effective for services rendered on or after July 1, 
  2.1   2002, the rate paid under paragraph (a) shall be equal to 300 
  2.2   percent of the statewide weighted average nursing facility rate 
  2.3   for case-mix level K for the reporting period ending on the 
  2.4   previous September 30.  The rate shall be updated annually each 
  2.5   January 1, beginning January 1, 2003. 
  2.6      Sec. 2.  [APPROPRIATION.] 
  2.7      $....... is appropriated from the general fund to the 
  2.8   commissioner of human services for fiscal year 2003 for the 
  2.9   purposes of section 1.
