  1.1                          A bill for an act 
  1.2             relating to education; requiring school districts and 
  1.3             charter schools to use a single uniform teacher 
  1.4             employment application form; directing the 
  1.5             commissioner of children, families, and learning to 
  1.6             design and transmit a single, uniform employment 
  1.7             application form for kindergarten through grade 12 
  1.8             teachers; amending Minnesota Statutes 2000, sections 
  1.9             123B.02, subdivision 14; 124D.10, subdivision 11.  
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  Minnesota Statutes 2000, section 123B.02, 
  1.12  subdivision 14, is amended to read: 
  1.13     Subd. 14.  [EMPLOYEES; CONTRACTS FOR SERVICES.] (a) The 
  1.14  board may employ and discharge necessary employees and may 
  1.15  contract for other services. 
  1.16     (b) The board must use the uniform employment application 
  1.17  form for kindergarten through grade 12 teachers developed by the 
  1.18  commissioner when employing teachers or contracting for 
  1.19  teachers' services; the board may ask applicants to submit 
  1.20  additional information, consistent with applicable law. 
  1.21     [EFFECTIVE DATE.] This section is effective January 1, 2003.
  1.22     Sec. 2.  Minnesota Statutes 2000, section 124D.10, 
  1.23  subdivision 11, is amended to read: 
  1.24     Subd. 11.  [EMPLOYMENT AND OTHER OPERATING MATTERS.] A 
  1.25  charter school must employ or contract with necessary teachers, 
  1.26  as defined by section 122A.15, subdivision 1, who hold valid 
  1.27  licenses to perform the particular service for which they are 
  2.1   employed in the school.  The charter school must use the uniform 
  2.2   employment application form for kindergarten through grade 12 
  2.3   teachers developed by the commissioner when employing teachers 
  2.4   or contracting for teachers' services; the charter school may 
  2.5   ask applicants to submit additional information, consistent with 
  2.6   applicable law.  The charter school's state aid may be reduced 
  2.7   under section 127A.42 if the school employs a teacher who is not 
  2.8   appropriately licensed or approved by the board of teaching.  
  2.9   The school may employ necessary employees who are not required 
  2.10  to hold teaching licenses to perform duties other than teaching 
  2.11  and may contract for other services.  The school may discharge 
  2.12  teachers and nonlicensed employees.  A person, without holding a 
  2.13  valid administrator's license, may perform administrative, 
  2.14  supervisory, or instructional leadership duties. 
  2.15     The board of directors also shall decide matters related to 
  2.16  the operation of the school, including budgeting, curriculum and 
  2.17  operating procedures.  
  2.18     [EFFECTIVE DATE.] This section is effective January 1, 2003.
  2.19     Sec. 3.  [UNIFORM EMPLOYMENT APPLICATION FORM FOR 
  2.20  TEACHERS.] 
  2.21     The commissioner of children, families, and learning, in 
  2.22  consultation with representatives of the Minnesota school boards 
  2.23  association, the Minnesota association of school personnel, 
  2.24  Education Minnesota, the information policy analysis division of 
  2.25  the Minnesota department of administration, and the state board 
  2.26  of teaching, must design and transmit to all school districts 
  2.27  and charter schools by November 15, 2002, a single, uniform 
  2.28  teacher employment application form.  School districts and 
  2.29  charter schools must use this teacher employment application 
  2.30  form beginning January 1, 2003, and later. 
  2.31     [EFFECTIVE DATE.] This section is effective the day 
  2.32  following final enactment.
