  1.1                          A bill for an act 
  1.2             relating to crime prevention; expanding the definition 
  1.3             of "crime of violence" in the gun control law; 
  1.4             amending Minnesota Statutes 1998, section 624.712, 
  1.5             subdivision 5. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 624.712, 
  1.8   subdivision 5, is amended to read: 
  1.9      Subd. 5.  [CRIME OF VIOLENCE.] "Crime of violence" includes 
  1.10  murder in the first, second, and third degrees, manslaughter in 
  1.11  the first and second degrees, aiding suicide, aiding attempted 
  1.12  suicide, felony violations of assault in the first, second, 
  1.13  third, and fourth degrees, assaults motivated by bias under 
  1.14  section 609.2231, subdivision 4, drive-by shootings, terroristic 
  1.15  threats, use of drugs to injure or to facilitate crime, crimes 
  1.16  committed for the benefit of a gang, commission of a crime while 
  1.17  wearing or possessing a bullet-resistant vest, simple robbery, 
  1.18  aggravated robbery, kidnapping, false imprisonment, criminal 
  1.19  sexual conduct in the first, second, third, and fourth degrees, 
  1.20  theft of a firearm, felony theft involving the intentional 
  1.21  taking or driving of a motor vehicle without the consent of the 
  1.22  owner or the authorized agent of the owner, felony theft 
  1.23  involving the taking of property from a burning, abandoned, or 
  1.24  vacant building, or from an area of destruction caused by civil 
  1.25  disaster, riot, bombing, or the proximity of battle, felony 
  2.1   theft involving the theft of a controlled substance, an 
  2.2   explosive, or an incendiary device, felony theft involving the 
  2.3   taking of property from the person of another, arson in the 
  2.4   first and second degrees, riot, burglary in the first, second, 
  2.5   third, and fourth degrees, harassment and stalking, shooting at 
  2.6   a public transit vehicle or facility, reckless use of a gun or 
  2.7   dangerous weapon, intentionally pointing a gun at or towards a 
  2.8   human being, setting a spring gun, and unlawfully owning, 
  2.9   possessing, operating a machine gun or short-barreled shotgun, 
  2.10  and an attempt to commit any of these offenses, as each of those 
  2.11  offenses is defined in chapter 609.  "Crime of violence" also 
  2.12  includes felony violations of the following:  malicious 
  2.13  punishment of a child; neglect or endangerment of a child; and 
  2.14  chapter 152. 
  2.15     Sec. 2.  [EFFECTIVE DATE.] 
  2.16     Section 1 is effective August 1, 2000, and applies to 
  2.17  crimes committed on or after that date.
