  1.1                          A bill for an act 
  1.2             relating to public safety; mandating access to source 
  1.3             code for radios purchased for 800-MHZ trunked radio 
  1.4             system and requiring at least two vendors. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [800-MHZ TRUNKED SYSTEM RADIOS.] 
  1.7      (a) Notwithstanding any other law to the contrary, any 
  1.8   contract by the state to purchase radios for use with the 
  1.9   infrastructure system architecture and software of the 800-MHZ 
  1.10  trunked radio system: 
  1.11     (1) must be let to more than one vendor; 
  1.12     (2) may be awarded only after full disclosure of and access 
  1.13  to the source code, to the extent required to operate with the 
  1.14  system's architecture, is made available to responsible vendors; 
  1.15  and 
  1.16     (3) must allow for interface interoperability. 
  1.17     (b) The vendor holding the source code for the system 
  1.18  architecture and its software applications shall escrow the 
  1.19  source code with the commissioner of administration within 60 
  1.20  days of the effective date of this act. 
  1.21     (c) No state agency shall bid a contract to purchase the 
  1.22  radios until at least 90 days have elapsed after the source code 
  1.23  is escrowed with the department of administration. 
  1.24     (d) For purposes of this section, "responsible vendors" are 
  1.25  limited to the signatories to the share technology agreement, 
  2.1   APCO Project 25, which are standards of the Association of 
  2.2   Public Safety Commission Officers. 
  2.3      Sec. 2.  [EFFECTIVE DATE.] 
  2.4      Section 1 is effective the day following final enactment.
