1.1 A bill for an act 1.2 relating to education; allowing, instead of requiring, 1.3 a district to reserve revenue for staff development 1.4 purposes; amending Minnesota Statutes 2001 Supplement, 1.5 section 122A.61, subdivision 1. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 2001 Supplement, section 1.8 122A.61, subdivision 1, is amended to read: 1.9 Subdivision 1. [STAFF DEVELOPMENT REVENUE.] A districtis1.10required tomay reservean amount equal to at least two percent1.11of thebasic revenue under section 126C.10, subdivision 2, for 1.12 in-service education for programs under section 120B.22, 1.13 subdivision 2, for staff development plans, including plans for 1.14 challenging instructional activities and experiences under 1.15 section 122A.60, and for curriculum development and programs, 1.16 other in-service education, teachers' workshops, teacher 1.17 conferences, the cost of substitute teachers staff development 1.18 purposes, preservice and in-service education for special 1.19 education professionals and paraprofessionals, and other related 1.20 costs for staff development efforts.A district may annually1.21waive the requirement to reserve their basic revenue under this1.22section if a majority vote of the licensed teachers in the1.23district and a majority vote of the school board agree to a1.24resolution to waive the requirement. A district in statutory1.25operating debt is exempt from reserving basic revenue according2.1to this section. Districts may expend an additional amount of2.2unreserved revenue for staff development based on their needs.2.3With the exception of amounts reserved for staff development2.4from revenues allocated directly to school sites,The boardmust2.5initiallymay allocate50 percent of thereserved revenue to 2.6 each school site in the district on a per teacher basis,which2.7must be retained by the school site until used. The board may2.8retain 25 percent to be usedor may use the revenue for district 2.9 wide staff development efforts. The remaining 25 percent of the2.10revenue must be usedor to make grants to school sites for best 2.11 practices methods. A grant may be used for any purpose 2.12 authorized under section 120B.22, subdivision 2, 122A.60, or for 2.13 the costs of curriculum development and programs, other 2.14 in-service education, teachers' workshops, teacher conferences, 2.15 substitute teachers for staff development purposes, and other 2.16 staff development efforts, and determined by the site 2.17 professional development team. The site professional 2.18 development team must demonstrate to the school board the extent 2.19 to which staff at the site have met the outcomes of the 2.20 program. The board may withholda portion of initial allocation2.21ofrevenue if the staff development outcomes are not being met. 2.22 [EFFECTIVE DATE.] This section is effective for the 2.23 2002-2003 school year and later.
