1.1 A bill for an act 1.2 relating to human services licensing; providing a tort 1.3 liability exclusion and indemnification of 1.4 municipalities; amending Minnesota Statutes 1998, 1.5 section 466.03, subdivision 6d. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 1998, section 466.03, 1.8 subdivision 6d, is amended to read: 1.9 Subd. 6d. [LICENSING OF PROVIDERS.]AAny claim against a 1.10 municipality based onthe failure of a provider to meet the1.11standards needed for a license to operate a day care facility1.12under chapter 245A for children, unless the municipality had1.13actual knowledge of a failure to meet licensing standards that1.14resulted in a dangerous condition that foreseeably threatened1.15the plaintifflicensing activities that have been delegated 1.16 under section 245A.16 shall be subject to the exclusions 1.17 contained in section 3.736, subdivision 3. The state shall 1.18 indemnify municipalities for any liability arising from 1.19 licensing actions carried out within the scope of section 1.20 245A.16.
