  1.1                          A bill for an act 
  1.2             relating to capital improvements; authorizing the 
  1.3             issuance of state bonds; appropriating money to the 
  1.4             Metropolitan Council for land banking grants. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [APPROPRIATION.] 
  1.7      (a) $3,750,000 is appropriated from the bond proceeds fund 
  1.8   to the Metropolitan Council for five grants of $750,000 to 
  1.9   regional park implementing agencies to acquire certain land for 
  1.10  land banking only.  The grants may only be used to acquire land 
  1.11  within the Metropolitan Council approved regional park master 
  1.12  plan boundaries. 
  1.13     (b) The appropriation is not available until the 
  1.14  commissioner determines that $3,000,000 has been committed to 
  1.15  the project from the Metropolitan Council and $750,000 from 
  1.16  regional park implementing agencies or other nonstate and 
  1.17  non-Metropolitan Council sources. 
  1.18     (c) Implementing agencies using the land banking funding 
  1.19  mechanism will be required to wait a minimum of two years before 
  1.20  the land is eligible for Metropolitan Council CIP funds and 
  1.21  before operation and maintenance funding can be allotted.  
  1.22  Implementing agencies would not be eligible for reimbursement 
  1.23  for early development undertaken prior to the end of the 
  1.24  two-year waiting period.  Funding for natural resource 
  1.25  protection and land stewardship is allowable for land acquired 
  2.1   under this program. 
  2.2      (d) Any new parks would have to go through the master 
  2.3   planning process and public hearing process to amend the 
  2.4   Regional Recreation Open Space Policy Plan as required by 
  2.5   Minnesota Statutes, section 473.147. 
  2.6      (e) The grants from this appropriation are only to be used 
  2.7   when the regional park implementing agency has used up its 
  2.8   regional park land acquisition capital grants. 
  2.9      (f) The grants must be made on a first-come, first-served 
  2.10  basis for qualifying projects until the funds are expended. 
  2.11     Sec. 2.  [BOND SALE.] 
  2.12     To provide the money appropriated in this act from the bond 
  2.13  proceeds fund, the commissioner of finance shall sell and issue 
  2.14  bonds of the state in an amount up to $3,750,000 in the manner, 
  2.15  upon the terms, and with the effect prescribed by Minnesota 
  2.16  Statutes, sections 16A.631 to 16A.675, and by the Minnesota 
  2.17  Constitution, article XI, sections 4 to 7. 
  2.18     Sec. 3.  [EFFECTIVE DATE.] 
  2.19     Sections 1 and 2 are effective the day following final 
  2.20  enactment.
