  1.1                          A bill for an act 
  1.2             relating to health; providing information on 
  1.3             FDA-approved methods of contraception and natural 
  1.4             family planning; amending Minnesota Statutes 2003 
  1.5             Supplement, section 256J.45, subdivision 2; proposing 
  1.6             coding for new law in Minnesota Statutes, chapter 145. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [145.4125] [FAMILY PLANNING INFORMATION.] 
  1.9      Before or after an abortion is or has been performed, the 
  1.10  hospital or health care facility performing the abortion must 
  1.11  provide the woman with written information on all FDA-approved 
  1.12  methods of contraception and natural family planning.  This 
  1.13  information must be provided within a reasonable time before or 
  1.14  after an abortion is to be performed. 
  1.15     Sec. 2.  [145.426] [FAMILY PLANNING WEB SITE.] 
  1.16     The commissioner of health shall develop and maintain as 
  1.17  part of the department's Web site information on family planning 
  1.18  to assist women and families in preventing unintended 
  1.19  pregnancies.  The Web site must provide information on family 
  1.20  planning methods, including all FDA-approved methods of 
  1.21  contraception and natural family planning. 
  1.22     Sec. 3.  Minnesota Statutes 2003 Supplement, section 
  1.23  256J.45, subdivision 2, is amended to read: 
  1.24     Subd. 2.  [GENERAL INFORMATION.] The MFIP orientation must 
  1.25  consist of a presentation that informs caregivers of: 
  1.26     (1) the necessity to obtain immediate employment; 
  2.1      (2) the work incentives under MFIP, including the 
  2.2   availability of the federal earned income tax credit and the 
  2.3   Minnesota working family tax credit; 
  2.4      (3) the requirement to comply with the employment plan and 
  2.5   other requirements of the employment and training services 
  2.6   component of MFIP, including a description of the range of work 
  2.7   and training activities that are allowable under MFIP to meet 
  2.8   the individual needs of participants; 
  2.9      (4) the consequences for failing to comply with the 
  2.10  employment plan and other program requirements, and that the 
  2.11  county agency may not impose a sanction when failure to comply 
  2.12  is due to the unavailability of child care or other 
  2.13  circumstances where the participant has good cause under 
  2.14  subdivision 3; 
  2.15     (5) the rights, responsibilities, and obligations of 
  2.16  participants; 
  2.17     (6) the types and locations of child care services 
  2.18  available through the county agency; 
  2.19     (7) the availability and the benefits of the early 
  2.20  childhood health and developmental screening under sections 
  2.21  121A.16 to 121A.19; 123B.02, subdivision 16; and 123B.10; 
  2.22     (8) the caregiver's eligibility for transition year child 
  2.23  care assistance under section 119B.05; 
  2.24     (9) the availability of all health care programs, including 
  2.25  transitional medical assistance; 
  2.26     (10) the caregiver's option to choose an employment and 
  2.27  training provider and information about each provider, including 
  2.28  but not limited to, services offered, program components, job 
  2.29  placement rates, job placement wages, and job retention rates; 
  2.30     (11) the caregiver's option to request approval of an 
  2.31  education and training plan according to section 256J.53; 
  2.32     (12) the work study programs available under the higher 
  2.33  education system; and 
  2.34     (13) information about the 60-month time limit exemptions 
  2.35  under the family violence waiver and referral information about 
  2.36  shelters and programs for victims of family violence; and 
  3.1      (14) information on family planning methods, including all 
  3.2   FDA-approved methods of contraception and natural family 
  3.3   planning, and the accessibility of the Minnesota Department of 
  3.4   Health's Web site as described in section 145.426.
