A bill for an act
relating to civil law; providing limits to liability for businesses and schools related
to COVID-19 transmission; proposing coding for new law in Minnesota Statutes,
chapter 604A.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) For purposes of this section, the following terms have
the meanings given in this subdivision.

(b) "Person" means: (1) an individual, association, for-profit or nonprofit entity, religious
organization, or charitable organization and the individual, association, for-profit or nonprofit
entity, religious organization, or charitable organization's officials, agents, and employees;
and (2) schools, including private and public schools.

(c) "Government guidance" means policies, procedures, regulations, or executive orders
related to COVID-19 issued by the federal government or the state government as guidance
to avoid contracting COVID-19.

A person in Minnesota is not liable in a civil
action for injury, damage, death of a person, or economic loss related to COVID-19 if the
act or omission at issue complied or was consistent with government guidance applicable
at the time of the alleged act or omission.

This section is effective retroactively from March 13, 2020, and
applies to causes of action accruing on or after that date.
