  1.1                          A bill for an act 
  1.2             relating to community education; establishing a school 
  1.3             district levy to pay for the colocation of government 
  1.4             services; proposing coding for new law in Minnesota 
  1.5             Statutes, chapter 124D. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [124D.215] [COMMUNITY EDUCATION UTILITIES 
  1.8   LEVY.] 
  1.9      Subdivision 1.  [ELIGIBILITY.] A district that operates an 
  1.10  existing district-owned facility for the primary purpose of 
  1.11  providing community education, early childhood and family 
  1.12  education, adult basic education, adult enrichment, senior 
  1.13  citizens services, school readiness, child care, or youth 
  1.14  services is eligible to levy under subdivision 2 if the district 
  1.15  colocates with other local units of government to provide these 
  1.16  services. 
  1.17     Subd. 2.  [LEVY.] An eligible district may levy an amount 
  1.18  equal to the lesser of the prior year's utility costs of 
  1.19  operating the building in which the services in subdivision 1 
  1.20  are provided, or $30 times the adjusted marginal cost pupil 
  1.21  units for the current year. 
  1.22     Subd. 3.  [REVOCATION.] The commissioner may deny or revoke 
  1.23  this levy authorization if the district and another local unit 
  1.24  of government are not colocating government services in the 
  1.25  district-owned building. 
  2.1      [EFFECTIVE DATE.] This section is effective for fiscal year 
  2.2   2006 and thereafter. 
  2.3      Sec. 2.  [LEVY RECOGNITION.] 
  2.4      For taxes payable in 2005 only, a school district that is 
  2.5   eligible to levy under Minnesota Statutes, section 124D.215, may 
  2.6   also levy an amount equal to the revenue that would have been 
  2.7   generated by Minnesota Statutes, section 124D.215, subdivision 
  2.8   2, for fiscal year 2005 and may recognize that revenue for 
  2.9   fiscal year 2005. 
  2.10     [EFFECTIVE DATE.] This section is effective for fiscal year 
  2.11  2006.
