  1.1                          A bill for an act 
  1.2             relating to motor vehicles; regulating abandoned motor 
  1.3             vehicles; requiring notice of taking; amending 
  1.4             Minnesota Statutes 2000, section 168B.06, subdivision

  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 168B.06, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [CONTENTS; NOTICE GIVEN WITHIN FIVE DAYS.] 
  1.10  When an impounded vehicle is taken into custody, the unit of 
  1.11  government or impound lot operator taking it into custody shall 
  1.12  give notice of the taking within five days.  The notice shall 
  1.13  (a) set forth the date and place of the taking, the reason or 
  1.14  reasons for the taking, including a citation to the state 
  1.15  statute or local ordinance that authorizes the taking, the year, 
  1.16  make, model and serial number of the impounded motor vehicle if 
  1.17  such information can be reasonably obtained, and the place where 
  1.18  the vehicle is being held, (b) inform the owner and any 
  1.19  lienholders of their right to reclaim the vehicle under section 
  1.20  168B.07, and (c) state that failure of the owner or lienholders 
  1.21  to exercise their right to reclaim the vehicle and contents 
  1.22  within the appropriate time allowed under section 168B.051, 
  1.23  subdivision 1, 1a, or 2, shall be deemed a waiver by them of all 
  1.24  right, title, and interest in the vehicle and contents and a 
  1.25  consent to the transfer of title to and disposal or sale of the 
  2.1   vehicle and contents pursuant to section 168B.08.  When an 
  2.2   impound lot operator takes an impounded vehicle into custody, 
  2.3   the operator shall notify the unit of government where the 
  2.4   taking occurred of this fact within 24 hours of the taking.
