1.1 A bill for an act 1.2 relating to waste management; creating a separate 1.3 account for revenue from solid waste management taxes; 1.4 providing for an excess revenue adjustment; amending 1.5 Minnesota Statutes 1998, sections 115A.554; 115A.918, 1.6 subdivision 1; and 297H.13, subdivisions 1, 2, and 4; 1.7 repealing Minnesota Statutes 1998, sections 115A.929; 1.8 115A.981; and 297H.13, subdivision 6. 1.9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.10 Section 1. Minnesota Statutes 1998, section 115A.554, is 1.11 amended to read: 1.12 115A.554 [AUTHORITY OF SANITARY DISTRICTS.] 1.13 A sanitary district has the authorities and duties of 1.14 counties within the district's boundary for purposes of sections 1.15 115A.0716; 115A.46, subdivisions 4 and 5; 115A.48; 115A.551; 1.16 115A.552; 115A.553; 115A.919;115A.929;115A.93; 115A.96, 1.17 subdivision 6; 115A.961; 116.072; 375.18, subdivision 14; 1.18 400.08; 400.16; and 400.161. 1.19 Sec. 2. Minnesota Statutes 1998, section 115A.918, 1.20 subdivision 1, is amended to read: 1.21 Subdivision 1. [SCOPE.] The definitions in this section 1.22 apply to this section and sections 115A.919 to115A.929115A.923. 1.23 Sec. 3. Minnesota Statutes 1998, section 297H.13, 1.24 subdivision 1, is amended to read: 1.25 Subdivision 1. [DEPOSIT OF REVENUES; SOLID WASTE 1.26 MANAGEMENT TAX ACCOUNT.] (a) The solid waste management and tax 1.27 account is established as an account in the state treasury. 2.1 (b) The revenues derived from the taxes imposed on waste 2.2 management services under this chapter, less the costs to the 2.3 department of revenue for administering the tax under this 2.4 chapter and the interest attributable to money in the account, 2.5 shall be deposited by the commissioner of revenuein the state2.6treasuryinto the solid waste management tax account. 2.7 (c) The amounts retained by the department of revenue shall 2.8 be deposited in a separate revenue department fund which is 2.9 hereby created. Money in this fund is hereby appropriated, up 2.10 to a maximum annual amount of $200,000, to the commissioner of 2.11 revenue for the costs incurred in administration of the solid 2.12 waste management tax under this chapter. 2.13 Sec. 4. Minnesota Statutes 1998, section 297H.13, 2.14 subdivision 2, is amended to read: 2.15 Subd. 2. [ALLOCATION OF REVENUESSOLID WASTE FUND 2.16 TRANSFER.](a)The commissioner of finance shall 2.17 transfer $22,000,000, or 50 percent, whichever is greater, of2.18the amounts remitted under this chapter must be creditedeach 2.19 year from the solid waste management tax account to the solid 2.20 waste fund established in section 115B.42. 2.21(b) The remainder must be deposited into the general fund.2.22 Sec. 5. Minnesota Statutes 1998, section 297H.13, 2.23 subdivision 4, is amended to read: 2.24 Subd. 4. [EXCESS REVENUE ADJUSTMENT.] If the total tax 2.25 revenues collected from the taxes imposed under this chapter in 2.26 any fiscal year1999is projected to exceed $44,500,000, the 2.27 commissioner of revenue shall decrease proportionately the 2.28 amount of the tax under sections 297H.02, 297H.03, 297H.04, and 2.29 297H.05, by an amount sufficient to eliminate the excess 2.30 effective October 1, 1999of the next fiscal year, and shall 2.31 provide notice of the decreased tax by August 1, 1999of the 2.32 next fiscal year, to waste management service providers. 2.33 Sec. 6. [REPEALER.] 2.34 Minnesota Statutes 1998, sections 115A.929; 115A.981; and 2.35 297H.13, subdivision 6, are repealed. 2.36 Sec. 7. [EFFECTIVE DATES.] 3.1 Sections 1, 2, 5, and 6 are effective the day following 3.2 final enactment. Sections 3 and 4 are effective July 1, 2001.
