  1.1                          A bill for an act 
  1.2             relating to energy; authorizing landowner payments for 
  1.3             hosting transmission facilities; proposing coding for 
  1.4             new law in Minnesota Statutes, chapter 216B.  
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [216B.2429] [LANDOWNER PAYMENTS.] 
  1.7      (a) A developer of a proposed high-voltage transmission 
  1.8   project certified as needed under section 216B.2425 or 216B.243 
  1.9   may negotiate with landowners along the proposed transmission 
  1.10  corridor to make payments to the landowners for hosting 
  1.11  transmission facilities associated with the certified project.  
  1.12  The developer may make these payments in addition to any 
  1.13  monetary award granted to a landowner as a result of eminent 
  1.14  domain proceedings associated with the proposed project. 
  1.15     (b) The commission may approve the recovery of landowner 
  1.16  payments made pursuant to paragraph (a) by a public utility and 
  1.17  may authorize recovery outside of a general rate proceeding 
  1.18  under section 216B.16 only if: 
  1.19     (1) the public utility first submits a landowner payment 
  1.20  plan to the commission for approval or for modification and 
  1.21  approval; 
  1.22     (2) the commission finds the plan to further the interests 
  1.23  of the utility's ratepayers and shareholders and to be otherwise 
  1.24  consistent with the public interest; and 
  1.25     (3) the landowner payments are consistent with that 
  2.1   approved plan.
