A bill for an act
relating to elections; requiring application for a waiver allowing certain overseas
absentee ballots to be counted.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin OVERSEAS VOTING WAIVER.

new text begin Within 90 days after this section becomes effective, the secretary of state shall apply
to the United States Secretary of Defense for a waiver allowing all overseas absentee
ballots cast before midnight on election day to be counted as valid votes if they are valid
in all other regards and are received before the meeting of the canvassing board. If such a
waiver is granted, those votes must be counted, other laws to the contrary notwithstanding.
