  1.1                          A bill for an act 
  1.2             relating to employment; prohibiting employers from 
  1.3             requiring employees or job applicants to pay for 
  1.4             certain expenses such as background checks, credit 
  1.5             checks, testing, or orientation; proposing coding for 
  1.6             new law in Minnesota Statutes, chapter 181. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [181.645] [EXPENSES FOR BACKGROUND CHECKS, 
  1.9   TESTING, AND ORIENTATION.] 
  1.10     Except as provided by section 123B.03 or as otherwise 
  1.11  specifically provided by law, an employer, as defined in section 
  1.12  181.931, or a prospective employer may not require an employee 
  1.13  or prospective employee to pay for expenses incurred in criminal 
  1.14  or background checks, credit checks, testing of any sort, or 
  1.15  orientation.  An employer or prospective employer may not 
  1.16  require an employee or prospective employee to pay for the 
  1.17  expenses of training that is required by federal or state law or 
  1.18  is required by the employer for the employee to maintain the 
  1.19  employee's current position, unless the training is required to 
  1.20  obtain or maintain a license, registration, or certification for 
  1.21  the employee or prospective employee.
