  1.1                          A bill for an act 
  1.2             relating to retirement; Minnesota State Retirement 
  1.3             System general plan; authorizing a general plan 
  1.4             deferred annuitant to have employment at 
  1.5             Bug-O-Na-Ge-Shig school used for rule of 90 
  1.6             eligibility purposes. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [MSRS DEFERRED ANNUITANT; ALLOWING USE OF 
  1.9   NONCOVERED EMPLOYMENT FOR RULE OF 90 ELIGIBILITY.] 
  1.10     Subdivision 1.  [AUTHORITY.] An eligible individual under 
  1.11  subdivision 2 is authorized to have the benefit treatment 
  1.12  specified in subdivision 3, providing the eligible individual 
  1.13  complies with all requirements under subdivision 4.  
  1.14     Subd. 2.  [ELIGIBILITY.] An eligible individual is an 
  1.15  individual who: 
  1.16     (1) is a Minnesota State Retirement System general plan 
  1.17  deferred member; 
  1.18     (2) was born on June 27, 1946; 
  1.19     (3) was the director of the Minnesota Indian scholarship 
  1.20  program from 1974 to 2002; 
  1.21     (4) due to an office closing, was terminated from Minnesota 
  1.22  State Retirement System general plan covered employment in late 
  1.23  2002; and 
  1.24     (5) was hired as a counselor at Bug-O-Na-Ge-Shig school in 
  1.25  August 2003. 
  1.26     Subd. 3.  [PROCEDURE.] An eligible individual under 
  2.1   subdivision 2 is authorized to have employment at the 
  2.2   Bug-O-Na-Ge-Shig school used for purposes of determining 
  2.3   eligibility for early retirement benefits provided under 
  2.4   Minnesota Statutes, section 352.116, subdivision 1, 
  2.5   notwithstanding any provisions of Minnesota Statutes, chapter 
  2.6   352, to the contrary.  The employment under this subdivision 
  2.7   must not be used as service credit for purposes of computing the 
  2.8   specified benefit.  
  2.9      Subd. 4.  [REQUIREMENTS.] (a) An eligible individual under 
  2.10  subdivision 2 and that individual's employer shall provide the 
  2.11  Minnesota State Retirement System executive director with any 
  2.12  information or reports that the executive director may request 
  2.13  to determine eligibility under this section and service provided 
  2.14  to the employer.  
  2.15     (b) An eligible individual is not entitled to a benefit 
  2.16  determined under this section until the eligible individual 
  2.17  terminates employment with the employer who owns, leases, or 
  2.18  operates the school specified in subdivision 2.  
  2.19     (c) A terminated eligible individual meeting requirements 
  2.20  of this subdivision, or an individual authorized to act on 
  2.21  behalf of that individual, may apply for an annuity following 
  2.22  application procedures under Minnesota Statutes, section 
  2.23  352.115, subdivision 7.  
  2.24     (d) Authority under this section is voided if an eligible 
  2.25  individual takes or has taken a refund under Minnesota Statutes, 
  2.26  section 352.22.  
  2.27     (e) The reemployed annuitant earnings limitations of 
  2.28  Minnesota Statutes, section 352.115, subdivision 10, apply to 
  2.29  any service by an eligible individual following reemployment 
  2.30  with the employer who owns, leases, or operates the school 
  2.31  specified in subdivision 2.  
  2.32     (f) Authority under this section is voided if the eligible 
  2.33  individual has defined benefit pension plan coverage for the 
  2.34  school employment specified in subdivision 2, or if the eligible 
  2.35  individual has received service credit, or is eligible to 
  2.36  receive service credit, in a defined benefit pension plan for 
  3.1   that school employment.  
  3.2      Sec. 2.  [EFFECTIVE DATE.] 
  3.3      Section 1 is effective the day following final enactment.
