  1.1                          A bill for an act 
  1.2             relating to human services; creating an exception to 
  1.3             the intermediate care facility for persons with mental 
  1.4             retardation and related conditions payment system; 
  1.5             amending Minnesota Statutes 2002, section 256B.5012, 
  1.6             by adding a subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 256B.5012, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 6.  [FACILITY CONVERSION.] (a) For the rate year 
  1.11  beginning July 1, 2004, a 51-bed facility located in Ramsey 
  1.12  County and licensed as an intermediate care facility for persons 
  1.13  with mental retardation and related conditions since 1977 shall 
  1.14  receive an incremental increase in rates of $15.73 per calendar 
  1.15  day above the rate in effect on June 30, 2004. 
  1.16     (b) Effective the day following final enactment until the 
  1.17  complete closure of this facility, the occupancy requirements 
  1.18  under section 256B.5012, and the hospital and therapeutic leave 
  1.19  provisions under Minnesota Rules, part 9505.0415, subparts 1 to 
  1.20  7, shall not apply during the conversion to closure of this 
  1.21  51-bed facility.
