  1.1                          A bill for an act 
  1.2             relating to health; exempting fundraisers for 
  1.3             educational, charitable, and religious organizations 
  1.4             from food establishment requirements; amending 
  1.5             Minnesota Statutes 1998, section 157.22.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 157.22, is 
  1.8   amended to read: 
  1.9      157.22 [EXEMPTIONS.] 
  1.10     This chapter and rules adopted under this chapter shall not 
  1.11  be construed to apply to: 
  1.12     (1) interstate carriers under the supervision of the United 
  1.13  States Department of Health and Human Services; 
  1.14     (2) any building constructed and primarily used for 
  1.15  religious worship; 
  1.16     (3) any building owned, operated, and used by a college or 
  1.17  university in accordance with health regulations promulgated by 
  1.18  the college or university under chapter 14; 
  1.19     (4) any person, firm, or corporation whose principal mode 
  1.20  of business is licensed under sections 28A.04 and 28A.05, is 
  1.21  exempt at that premises from licensure as a food or beverage 
  1.22  establishment; provided that the holding of any license pursuant 
  1.23  to sections 28A.04 and 28A.05 shall not exempt any person, firm, 
  1.24  or corporation from the applicable provisions of this chapter or 
  1.25  the rules of the state commissioner of health relating to food 
  2.1   and beverage service establishments; 
  2.2      (5) family day care homes and group family day care homes 
  2.3   governed by sections 245A.01 to 245A.16; 
  2.4      (6) nonprofit senior citizen centers for the sale of 
  2.5   home-baked goods; and 
  2.6      (7) food not prepared at an establishment and brought in by 
  2.7   members of an organization for consumption by members at a 
  2.8   potluck event; and 
  2.9      (8) food not prepared at an establishment and brought in by 
  2.10  members of an educational, charitable, or religious organization 
  2.11  for consumption by or sale to members of the public at an 
  2.12  advertised or unadvertised fundraising event, provided the 
  2.13  organization is not regularly engaged in the business of 
  2.14  manufacturing, processing, or selling food.
