  1.1                          A bill for an act
  1.2             relating to immigration; requiring commissioner of 
  1.3             children, families, and learning to use the SAVE 
  1.4             system to verify immigration status of applicants for 
  1.5             child care assistance; requiring commissioner of human 
  1.6             services to use the SAVE system to verify immigration 
  1.7             status of applicants for assistance; amending 
  1.8             Minnesota Statutes 1998, sections 119B.02, by adding a 
  1.9             subdivision; 256.01, by adding a subdivision; and 
  1.10            256J.32, by adding a subdivision. 
  1.11  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.12     Section 1.  Minnesota Statutes 1998, section 119B.02, is 
  1.13  amended by adding a subdivision to read: 
  1.14     Subd. 6.  [IMMIGRATION STATUS VERIFICATIONS.] The 
  1.15  commissioner shall utilize the Systematic Alien Verification for 
  1.16  Entitlements (SAVE) program to conduct immigration status 
  1.17  verifications of all applicants for MFIP child care assistance 
  1.18  or basic sliding fee child care assistance, as required under 
  1.19  United States Code, title 8, section 1642. 
  1.20     Sec. 2.  Minnesota Statutes 1998, section 256.01, is 
  1.21  amended by adding a subdivision to read: 
  1.22     Subd. 18.  [IMMIGRATION STATUS 
  1.23  VERIFICATIONS.] Notwithstanding any waiver of this requirement 
  1.24  by the secretary of the United States Department of Health and 
  1.25  Human Services, the commissioner shall utilize the Systematic 
  1.26  Alien Verification for Entitlements (SAVE) program to conduct 
  1.27  immigration status verifications: 
  1.28     (1) as required under United States Code, title 8, section 
  2.1   1642; 
  2.2      (2) for all applicants for food assistance benefits, 
  2.3   whether under the federal food stamp program, the MFIP or work 
  2.4   first program, or the Minnesota food assistance program; 
  2.5      (3) for all applicants for general assistance medical care, 
  2.6   except assistance for an emergency medical condition, for 
  2.7   immunization with respect to an immunizable disease, or for 
  2.8   testing and treatment of symptoms of a communicable disease; and 
  2.9      (4) for all applicants for general assistance, Minnesota 
  2.10  supplemental aid, MinnesotaCare, or group residential housing, 
  2.11  when the benefits provided by these programs would fall under 
  2.12  the definition of "federal public benefit" under United States 
  2.13  Code, title 8, section 1642, if federal funds were used to pay 
  2.14  for all or part of the benefits.  
  2.15     The commissioner shall report to the Immigration and 
  2.16  Naturalization Services all undocumented persons who have been 
  2.17  identified either through the SAVE program, through the county 
  2.18  agency's application verification procedures, or by the 
  2.19  self-admission of an applicant for assistance.  Reports made 
  2.20  under this subdivision must comply with the requirements of 
  2.21  section 411A of the Social Security Act, as amended, and United 
  2.22  States Code, title 8, section 1644. 
  2.23     Sec. 3.  Minnesota Statutes 1998, section 256J.32, is 
  2.24  amended by adding a subdivision to read: 
  2.25     Subd. 7a.  [REQUIREMENT TO REPORT TO IMMIGRATION AND 
  2.26  NATURALIZATION SERVICES.] Notwithstanding subdivision 7, the 
  2.27  commissioner shall report to the Immigration and Naturalization 
  2.28  Services all undocumented persons who have been identified 
  2.29  either through the SAVE program, through the county agency's 
  2.30  verification procedures under this section, or by the 
  2.31  self-admission of an applicant for assistance.  Reports made 
  2.32  under this subdivision must comply with the requirements of 
  2.33  section 411A of the Social Security Act, as amended, and United 
  2.34  States Code, title 8, section 1644.
