  1.1                          A bill for an act 
  1.2             relating to the military; clarifying eligibility for 
  1.3             membership in the National Guard and the organized 
  1.4             militia; amending Minnesota Statutes 1998, section 
  1.5             190.06, subdivisions 1 and 3.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 190.06, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [COMPOSITION.] The militia shall consist of 
  1.10  all able-bodied male citizens of the state and all other 
  1.11  able-bodied males, resident therein persons, who have or shall 
  1.12  have declared their intention to become citizens of the United 
  1.13  States, when so authorized by federal law, who shall be 18 or 
  1.14  more years of age, and, except as otherwise provided, comply 
  1.15  with the minimum age requirements for federal regular military 
  1.16  service under United States Code, title 10, section 505, and who 
  1.17  are not more than 45 years of age; provided, that the governor 
  1.18  may, when the governor deems it necessary for the defense of the 
  1.19  state, extend the maximum age for militia service to not more 
  1.20  than 64 years. 
  1.21     Sec. 2.  Minnesota Statutes 1998, section 190.06, 
  1.22  subdivision 3, is amended to read: 
  1.23     Subd. 3.  [NONCOMBATANT SERVICE.] The governor may 
  1.24  authorize the appointment or enlistment of citizens of the state 
  1.25  and all other residents of the state persons, who have or shall 
  2.1   have declared their intention to become citizens of the United 
  2.2   States, in the medical corps, nurse corps, and other 
  2.3   noncombatant branches and services of the organized militia, and 
  2.4   while so serving they shall have the same status as members of 
  2.5   the military forces.
