  1.1                          A bill for an act 
  1.2             relating to higher education; providing for collection 
  1.3             of data on how many students are employed in this 
  1.4             state after obtaining a degree; amending Minnesota 
  1.5             Statutes 2000, section 13.322, subdivision 2; 
  1.6             proposing coding for new law in Minnesota Statutes, 
  1.7             chapter 135A. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2000, section 13.322, 
  1.10  subdivision 2, is amended to read: 
  1.11     Subd. 2.  [PUBLIC POST-SECONDARY EDUCATION; IMMUNIZATION 
  1.12  FILES.] (a) [IMMUNIZATION FILES.] Data sharing of immunization 
  1.13  records is governed by section 135A.14, subdivision 4. 
  1.14     (b) [EMPLOYMENT IN STATE.] Data collected on students who 
  1.15  are employed in this state after obtaining a degree is governed 
  1.16  by section 135A.55. 
  1.17     Sec. 2.  [135A.55] [NONRESIDENT STUDENTS; EMPLOYMENT IN 
  1.18  THIS STATE.] 
  1.19     Subdivision 1.  [DEFINITION.] For purposes of this section, 
  1.20  "nonresident student" means a student other than a resident 
  1.21  student as defined in section 136A.101, subdivision 8. 
  1.22     Subd. 2.  [TRACKING SYSTEM.] (a) For purposes of 
  1.23  determining what proportion of resident students as defined in 
  1.24  section 136A.101, subdivision 8, and nonresident students who 
  1.25  obtain a degree from the University of Minnesota or the 
  1.26  Minnesota state colleges and universities are subsequently 
  2.1   employed in this state, the governing boards of the University 
  2.2   of Minnesota and the Minnesota state colleges and universities 
  2.3   must comply with this section. 
  2.4      (b) On and after the effective date of this section, each 
  2.5   student at the University of Minnesota or the Minnesota state 
  2.6   colleges and universities must receive the notice in paragraph 
  2.7   (c) when the student is informed that the student will be 
  2.8   granted a degree. 
  2.9      (c) Each student must be notified in an easily 
  2.10  understandable written form that the student is requested to 
  2.11  participate in data collection under this section as follows: 
  2.12     (1) the student's consent is requested to use the student's 
  2.13  social security number for purposes of tracking how many 
  2.14  resident and nonresident students are employed in this state 
  2.15  after receiving a degree from the University of Minnesota or the 
  2.16  Minnesota state colleges and universities; 
  2.17     (2) the student's consent is optional and no adverse action 
  2.18  may be taken against the student for declining to give consent; 
  2.19  and 
  2.20     (3) the social security number will be shared with the 
  2.21  higher education services office and the department of revenue 
  2.22  to accomplish the purposes of this section and will not be used 
  2.23  for any other purpose or reported to any other government entity.
  2.24     (d) By December 31, 2002, the governing boards of the 
  2.25  University of Minnesota and the Minnesota state colleges and 
  2.26  universities must forward to the higher education services 
  2.27  office the social security numbers of all students who have 
  2.28  given their written consent after receiving the notice under 
  2.29  paragraph (c).  Each subsequent year on December 31, the 
  2.30  governing boards of the University of Minnesota and the 
  2.31  Minnesota state colleges and universities must forward to the 
  2.32  higher education services office the social security numbers of 
  2.33  all students who have given their written consent under 
  2.34  paragraph (c) and have received a degree from the respective 
  2.35  institutions since the most recent previous report by the 
  2.36  governing boards under this paragraph.  The social security 
  3.1   numbers must be reported in a way that separates resident 
  3.2   students from nonresident students. 
  3.3      (e) Upon receiving social security numbers under paragraph 
  3.4   (d), the higher education services office must forward them to 
  3.5   the department of revenue to electronically match them with 
  3.6   income tax returns filed in this state.  In addition, the higher 
  3.7   education services office must resubmit to the department of 
  3.8   revenue each group of social security numbers received under 
  3.9   paragraph (d) on December 31 of each year after the initial 
  3.10  receipt of the social security numbers by the higher education 
  3.11  services offices.  Within 30 days after receiving social 
  3.12  security numbers from the higher education services office, the 
  3.13  department of revenue must compile the results of this data 
  3.14  match and release it to the higher education services office.  
  3.15  The data must be released in the form of summary data that 
  3.16  indicates how many of the data subjects filed an income tax 
  3.17  return in this state, but does not identify any individual.  The 
  3.18  higher education services office may make this summary data 
  3.19  public and must report it to the legislature within 30 days 
  3.20  after receiving it.
