A bill for an act
relating to state government; prohibiting layoffs if the appointing authority
intends to rehire part time; proposing coding for new law in Minnesota Statutes,
chapter 43A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin [43A.335] CERTAIN LAYOFFS PROHIBITED.

new text begin An executive branch appointing authority may not lay off an employee if at the time
of the layoff the appointing authority intends to rehire the employee to work part time.
For purposes of this section, "layoff" means termination of employment due to abolition
of a position, shortage of work or funds, or other reasons outside an employee's control
which do not reflect discredit on the service of the employee.
