  1.1                          A bill for an act 
  1.2             relating to real property; housing and redevelopment 
  1.3             authority residential properties; preserving housing 
  1.4             authority ability to lease townhome and condominium 
  1.5             properties to eligible tenants; amending Minnesota 
  1.6             Statutes 2002, section 469.018, by adding a 
  1.7             subdivision. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2002, section 469.018, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 3.  [PROHIBITION ON LEASE 
  1.12  RESTRICTIONS.] Notwithstanding any other law to the contrary, no 
  1.13  declaration governing a common interest community, as defined in 
  1.14  chapter 515B, whether or not the common interest community is 
  1.15  subject to chapter 515B, and no bylaw, regulation, rule, or 
  1.16  policy adopted by or on behalf of the unit owners' association 
  1.17  for a common interest community, may prohibit or limit an 
  1.18  authority from leasing a residential unit owned by it to 
  1.19  eligible persons of low or moderate income and their families 
  1.20  under applicable state or federal legislation.  Nothing in this 
  1.21  subdivision shall prohibit common interest community 
  1.22  declarations, bylaws, regulations, rules, or policies from 
  1.23  otherwise regulating the use of a unit owned by an authority or 
  1.24  the conduct of unit occupants, provided the regulations apply to 
  1.25  all units in the common interest community.  This subdivision 
  1.26  applies to all common interest community units owned by an 
  2.1   authority title that was acquired by the authority after January 
  2.2   1, 1999. 
  2.3      Sec. 2.  [EFFECTIVE DATE.] 
  2.4      This act is effective the day following final enactment.
