  1.1                          A bill for an act
  1.2             relating to retirement; authorizing purchase of 
  1.3             service credit from the Minnesota state retirement 
  1.4             system for certain periods of military service; 
  1.5             proposing coding for new law in Minnesota Statutes, 
  1.6             chapter 352. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [352.275] [UNCREDITED MILITARY SERVICE CREDIT 
  1.9   PURCHASE.] 
  1.10     Subdivision 1.  [SERVICE CREDIT PURCHASE AUTHORIZED.] A 
  1.11  state employee who has at least three years of allowable service 
  1.12  with the Minnesota state retirement system and who performed 
  1.13  service in the United States armed forces before becoming a 
  1.14  state employee, or who failed to obtain service credit for a 
  1.15  military leave of absence under section 352.27, is entitled to 
  1.16  purchase allowable service credit for the initial period of 
  1.17  enlistment, induction, or call to active duty without any 
  1.18  voluntary extension by making payment under section 356.55 
  1.19  provided the employee is not entitled to receive a current or 
  1.20  deferred retirement annuity from a United States armed forces 
  1.21  pension plan and has not purchased service credit from any other 
  1.22  defined benefit public employee pension plan for the same period 
  1.23  of service. 
  1.24     Subd. 2.  [APPLICATION AND DOCUMENTATION.] An employee who 
  1.25  desires to purchase service credit under subdivision 1 must 
  1.26  apply with the executive director to make the purchase.  The 
  2.1   application must include all necessary documentation of the 
  2.2   employee's qualifications to make the purchase, signed written 
  2.3   permission to allow the executive director to request and 
  2.4   receive necessary verification of applicable facts and 
  2.5   eligibility requirements, and any other relevant information 
  2.6   that the executive director may require. 
  2.7      Subd. 3.  [SERVICE CREDIT GRANT.] Allowable service credit 
  2.8   for the purchase period must be granted by the Minnesota state 
  2.9   retirement system to the purchasing employee upon receipt of the 
  2.10  purchase payment amount.  Payment must be made before the 
  2.11  employee's effective date of retirement.
