  1.1                          A bill for an act 
  1.2             relating to human services; providing a choice of 
  1.3             county or private agency case management vendor for 
  1.4             persons with mental retardation or related conditions; 
  1.5             amending Minnesota Statutes 2000, section 256B.092, 
  1.6             subdivisions 2a, 4b. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 256B.092, 
  1.9   subdivision 2a, is amended to read: 
  1.10     Subd. 2a.  [MEDICAL ASSISTANCE FOR CASE MANAGEMENT 
  1.11  ACTIVITIES UNDER THE STATE PLAN MEDICAID OPTION.] (a) Upon 
  1.12  receipt of federal approval, the commissioner shall make 
  1.13  payments to approved vendors of case management services 
  1.14  participating in the medical assistance program to reimburse 
  1.15  costs for providing case management service activities to 
  1.16  medical assistance eligible persons with mental retardation or a 
  1.17  related condition, in accordance with the state Medicaid plan 
  1.18  and federal requirements and limitations. 
  1.19     (b) The commissioner shall ensure that each eligible person 
  1.20  is given a choice of county and private agency case management 
  1.21  service providers.  Case management service providers are 
  1.22  prohibited from providing any other service to the person 
  1.23  receiving case management services. 
  1.24     Sec. 2.  Minnesota Statutes 2000, section 256B.092, 
  1.25  subdivision 4b, is amended to read: 
  1.26     Subd. 4b.  [CASE MANAGEMENT FOR PERSONS RECEIVING HOME AND 
  2.1   COMMUNITY-BASED SERVICES.] (a) Persons authorized for and 
  2.2   receiving home and community-based services may select from 
  2.3   public and private vendors of case management which have 
  2.4   provider agreements with the state to provide home and 
  2.5   community-based case management service activities.  This 
  2.6   subdivision becomes effective July 1, 1992, only if the state 
  2.7   agency is unable to secure federal approval for limiting choice 
  2.8   of case management vendors to the county of financial 
  2.9   responsibility. 
  2.10     (b) The commissioner shall ensure that each eligible person 
  2.11  is given a choice of county and private agency case management 
  2.12  service providers.  Case management service providers are 
  2.13  prohibited from providing any other service to the person 
  2.14  receiving case management services. 
  2.15     Sec. 3.  [FEDERAL APPROVAL.] 
  2.16     The commissioner of human services shall request, by 
  2.17  September 1, 2002, any federal approval and plan amendments 
  2.18  necessary to implement the choice of case manager provisions in 
  2.19  Minnesota Statutes, section 256B.092, subdivisions 2a and 4b.
