  1.1                          A bill for an act 
  1.2             relating to human services; requiring the commissioner 
  1.3             of human services to implement the pharmaceutical care 
  1.4             demonstration project upon federal approval; 
  1.5             appropriating money; amending Laws 2003, First Special 
  1.6             Session chapter 14, article 12, section 99.  
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Laws 2003, First Special Session chapter 14, 
  1.9   article 12, section 99, is amended to read: 
  1.10     Sec. 99.  [PHARMACEUTICAL CARE DEMONSTRATION PROJECT.] 
  1.11     (a) The commissioner shall seek federal approval for a 
  1.12  demonstration project to provide culturally specific 
  1.13  pharmaceutical care to American Indian medical assistance 
  1.14  recipients who are age 55 and older.  In developing the 
  1.15  demonstration project, the commissioner shall consult with 
  1.16  organizations and health care providers experienced in 
  1.17  developing and implementing culturally competent intervention 
  1.18  strategies to manage the use of prescription drugs, 
  1.19  over-the-counter drugs, other drug products, and native 
  1.20  therapies by American Indian elders.  
  1.21     (b) For purposes of this section, "pharmaceutical care" 
  1.22  means the provision of drug therapy and native therapy for the 
  1.23  purpose of improving a patient's quality of life by:  (1) curing 
  1.24  a disease; (2) eliminating or reducing a patient's symptoms; (3) 
  1.25  arresting or slowing a disease process; or (4) preventing a 
  1.26  disease or a symptom.  Pharmaceutical care involves the 
  2.1   documented process through which a pharmacist cooperates with a 
  2.2   patient and other professionals in designing, implementing, and 
  2.3   monitoring a therapeutic plan that is expected to produce 
  2.4   specific therapeutic outcomes, through the identification, 
  2.5   resolution, and prevention of drug-related problems.  Nothing in 
  2.6   this project shall be construed to expand or modify the scope of 
  2.7   practice of the pharmacist as defined in Minnesota Statutes, 
  2.8   section 151.01, subdivision 27. 
  2.9      (c) Upon receipt of federal approval, the commissioner 
  2.10  shall report to the legislature for legislative approval for 
  2.11  implementation of implement the demonstration project and shall 
  2.12  present recommendations to the legislature no later than 90 days 
  2.13  after completion of the demonstration project on whether the 
  2.14  project shall be continued or expanded. 
  2.15     Sec. 2.  [APPROPRIATION.] 
  2.16     $....... is appropriated from the general fund to the 
  2.17  commissioner of human services for the fiscal year ending June 
  2.18  30, 2005, to implement the pharmaceutical care demonstration 
  2.19  project under section 1.
