A bill for an act
relating to natural resources; prohibiting watershed district boundary changes
to be reconsidered until one year has passed if the request is made via citizen
petition; amending Minnesota Statutes 2008, section 103D.251, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 103D.251, is amended by adding a
subdivision to read:

new text begin The board shall not initiate a
proceeding to change the boundary of a watershed district when the boundary change is
requested by petition signed by resident owners according to subdivision 5, paragraph
(a), clause (4), until one year has passed since the last established boundary change for
the watershed district has gone into effect.

new text begin This section is effective retroactively from January 1, 2009,
and applies to boundary changes established by the Board of Water and Soil Resources
on or after that date.
