  1.1                          A bill for an act 
  1.2             relating to education; providing for the destruction 
  1.3             of the state test of the basic requirement for written 
  1.4             composition; requiring that students be retested for 
  1.5             the basic requirement for written composition; 
  1.6             requiring legislative approval of the test prompt for 
  1.7             the basic requirement of written composition. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [TESTING FOR BASIC REQUIREMENT OF WRITTEN 
  1.10  COMPOSITION.] 
  1.11     Subdivision 1.  [JANUARY 26, 2000, WRITTEN COMPOSITION TEST 
  1.12  RESULTS.] (a) Within seven days of the effective date of this 
  1.13  section, every school district, the department of children, 
  1.14  families, and learning, every independent vendor contracted to 
  1.15  score the state test of the basic requirement for written 
  1.16  composition under the graduation rule in Minnesota Statutes, 
  1.17  section 120B.02, and administered on January 26, 2000, or any 
  1.18  other persons or entities that have in their possession the test 
  1.19  booklets, test results, or test prompt for the basic requirement 
  1.20  for written composition administered to students on January 26, 
  1.21  2000, must destroy the test booklets, test results, and test 
  1.22  prompt.  The test prompt for the basic requirement for written 
  1.23  composition administered on January 26, 2000, may no longer be 
  1.24  administered to students.  The school district, department of 
  1.25  children, families, and learning, independent vendor, or any 
  1.26  other persons or entities that destroys the test booklets, test 
  2.1   results, or test prompt must confirm in writing to the chairs of 
  2.2   the house and senate education committees that the test 
  2.3   booklets, test results, and test prompt in their possession were 
  2.4   destroyed. 
  2.5      (b) A student response to, or test result from, the state 
  2.6   test of the basic requirement in written composition must not be 
  2.7   included in educational data on the student.  For the purposes 
  2.8   of this subdivision, "educational data" is as defined in 
  2.9   Minnesota Statutes, section 13.32, subdivision 1. 
  2.10     Subd. 2.  [ADDITIONAL TESTING; 1999-2000 SCHOOL YEAR.] A 
  2.11  school district shall administer a state test, other than that 
  2.12  administered under subdivision 1, of the basic requirement in 
  2.13  written composition before the end of the 1999-2000 school 
  2.14  year.  The prompt for the state test under Minnesota Rules, part 
  2.15  3501.0250, developed by the department of children, families, 
  2.16  and learning, must be submitted within 14 days of the effective 
  2.17  date of this section to each member of the house and senate 
  2.18  education committees for approval before the test is 
  2.19  administered to students.  The department of children, families, 
  2.20  and learning and the house and senate education committees shall 
  2.21  take all steps necessary to ensure that the test contents remain 
  2.22  unknown as required under Minnesota Rules, part 3501.0250, 
  2.23  subpart 6, item D. 
  2.24     Subd. 3.  [CONFLICT OF LAW.] This section supersedes any 
  2.25  conflicting provision of law to the contrary. 
  2.26     Sec. 2.  [EFFECTIVE DATE.] 
  2.27     Section 1 is effective the day following final enactment.
