  1.1                          A bill for an act 
  1.2             relating to civil action; providing for certain 
  1.3             conduct by public school students being subject to 
  1.4             disciplinary action and possible removal of a student 
  1.5             from class; amending Minnesota Statutes 1998, section 
  1.6             121A.61, subdivision 3. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 121A.61, 
  1.9   subdivision 3, is amended to read: 
  1.10     Subd. 3.  [POLICY COMPONENTS.] The policy must include at 
  1.11  least the following components:  
  1.12     (a) (1) rules governing student conduct and procedures for 
  1.13  informing students of the rules; including, but not limited to: 
  1.14     (i) when a teacher or administrator enters a room in a 
  1.15  public school, each student present in the room shall stand and 
  1.16  shall remain standing until the teacher or administrator 
  1.17  instructs the student or students to be seated; 
  1.18     (ii) when a student is speaking with a teacher or 
  1.19  administrator while on school property or at a school sponsored 
  1.20  activity, the student shall address and respond to the teacher 
  1.21  or administrator by using the respectful terms "Yes, Ma'am" and 
  1.22  "No, Ma'am" or "Yes, Sir" and "No, Sir," as appropriate, or 
  1.23  "Yes, Miss, Mrs., or Ms. (surname)" and "No, Miss, Mrs., or Ms. 
  1.24  (surname)" or "Yes, Mr. (surname)" and "No, Mr. (surname)," as 
  1.25  appropriate; and 
  1.26     (iii) a student shall not wear a cap, hat, or other head 
  2.1   covering in a school except when the wearing of the cap, hat, or 
  2.2   other head covering is authorized by a school administrator or 
  2.3   teacher; 
  2.4      (2) procedures for informing students of the rules; 
  2.5      (b) (3) the grounds for removal of a student from a class; 
  2.6      (c) (4) the authority of the classroom teacher to remove 
  2.7   students from the classroom pursuant to procedures and rules 
  2.8   established in the district's policy; 
  2.9      (d) (5) the procedures for removal of a student from a 
  2.10  class by a teacher, school administrator, or other school 
  2.11  district employee; 
  2.12     (e) (6) the period of time for which a student may be 
  2.13  removed from a class, which may not exceed five class periods 
  2.14  for a violation of a rule of conduct; 
  2.15     (f) (7) provisions relating to the responsibility for and 
  2.16  custody of a student removed from a class; 
  2.17     (g) (8) the procedures for return of a student to the 
  2.18  specified class from which the student has been removed; 
  2.19     (h) (9) the procedures for notifying a student and the 
  2.20  student's parents or guardian of violations of the rules of 
  2.21  conduct and of resulting disciplinary actions; 
  2.22     (i) (10) any procedures determined appropriate for 
  2.23  encouraging early involvement of parents or guardians in 
  2.24  attempts to improve a student's behavior; 
  2.25     (j) (11) any procedures determined appropriate for 
  2.26  encouraging early detection of behavioral problems; 
  2.27     (k) (12) any procedures determined appropriate for 
  2.28  referring a student in need of special education services to 
  2.29  those services; 
  2.30     (1) (13) the procedures for consideration of whether there 
  2.31  is a need for a further assessment or of whether there is a need 
  2.32  for a review of the adequacy of a current individual education 
  2.33  plan of a student with a disability who is removed from class; 
  2.34     (m) (14) procedures for detecting and addressing chemical 
  2.35  abuse problems of a student while on the school premises; 
  2.36     (n) (15) the minimum consequences for violations of the 
  3.1   code of conduct; and 
  3.2      (o) (16) procedures for immediate and appropriate 
  3.3   interventions tied to violations of the code.  
  3.4      Sec. 2.  [EFFECTIVE DATE.] 
  3.5      Section 1 is effective for the 2001-2002 school year and 
  3.6   thereafter.
