A bill for an act
relating to capital improvements; appropriating money to acquire the Pine Island
Spur Railroad right-of-way in Rochester; authorizing the sale and issuance of
state bonds.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

$1,500,000 is appropriated from the bond proceeds fund to the commissioner
of natural resources for a grant to the city of Rochester to acquire the Pine Island Spur
Railroad right-of-way, located in Rochester, from the Dakota, Minnesota and Eastern
Railroad. This right-of-way is for a planned multimodal transportation corridor in the city
of Rochester, and acquisition is required before constructing federally funded phase 2 and
3, bike trail, and grade-separated bridge improvements in 2010 and 2012, respectively.
The right-of-way purchase will allow the connection of the state's Douglas Trailhead
to the city's Cascade Lake Regional Park, while providing future transportation modes
interconnectivity to various parts of the city, county, and region.

To provide the money appropriated in section 1 from the bond proceeds fund, the
commissioner of management and budget shall sell and issue bonds of the state in an
amount up to $1,500,000 in the manner, upon the terms, and with the effect prescribed by
Minnesota Statutes, sections 16A.631 to 16A.675, and by the Minnesota Constitution,
article XI, sections 4 to 7.
