  1.1                          A bill for an act 
  1.2             relating to higher education; tuition; providing 
  1.3             resident tuition to nonresidents under certain 
  1.4             circumstances; proposing coding for new law in 
  1.5             Minnesota Statutes, chapter 136F.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [136F.283] [NONRESIDENT TUITION; COMMUNITY AND 
  1.8   TECHNICAL COLLEGES.] 
  1.9      Subdivision 1.  [TUITION.] (a) A nonresident is eligible to 
  1.10  attend a state community or technical college in Minnesota at 
  1.11  the Minnesota resident tuition rate, if the person agrees to 
  1.12  remain domiciled in Minnesota for at least seven consecutive 
  1.13  years following graduation as an employed, resident taxpayer. 
  1.14     (b) A person desiring to take advantage of the resident 
  1.15  tuition provided in paragraph (a), shall sign a contract with 
  1.16  state colleges and universities detailing the requirements 
  1.17  provided in paragraph (a).  If the person fails to comply with 
  1.18  the requirements of the contract, the person shall be 
  1.19  responsible for reimbursing state colleges and universities for 
  1.20  tuition at the nonresident rate. 
  1.21     Subd. 2.  [DEFINITIONS.] For purposes of this section, the 
  1.22  following terms have the meaning given:  
  1.23     (a) "Nonresident" means a person who: 
  1.24     (1) is a dependent, whose parent or legal guardian does not 
  1.25  reside in Minnesota at the time the person applies; or 
  2.1      (2) is independent and has not resided in Minnesota for at 
  2.2   least 12 consecutive months without being enrolled at a 
  2.3   post-secondary educational institution for more than five 
  2.4   credits in any term. 
  2.5      (b) "State community or technical college" means an 
  2.6   institution designated as a community college, community college 
  2.7   center, or technical college in section 136F.10.  
  2.8      (c) "Employed" means the person is: 
  2.9      (1) working or otherwise performing services for 
  2.10  compensation in Minnesota, for an employer that is located and 
  2.11  doing business in Minnesota; or 
  2.12     (2) available for employment and actively seeking 
  2.13  employment as those terms are defined in section 268.085, 
  2.14  subdivisions 15 and 16.
