A bill for an act
relating to employment; prohibiting termination under certain circumstances.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) An employer is prohibited from terminating an employee on the basis of the
employee's absence for up to seven consecutive days of work if the sole purpose of the
absence is:

(1) to care for a person diagnosed with the H1N1 virus; or

new text begin
(2) to care for a person whose school, child care facility, or adult day care facility
has been closed due to the H1N1 virus.

(b) For the purpose of this section, "person" means an individual who is:

(1) under the age of 18 or disabled; and
new text end
new text begin
(2) the employee's child, foster child, stepchild, or grandchild.

This section is effective the day following final enactment.
