A bill for an act
relating to transportation; increasing fine for using a wireless communications
device while driving; amending Minnesota Statutes 2018, section 169.475,
subdivision 2.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2018, section 169.475, subdivision 2, is amended to read:

(b) A person who violates paragraph (a)new text begin is subject to the following fines:

(1) for a first offense, a fine of $175, plus the amount specified in the uniform fine
schedule established by the Judicial Council;

new text begin (2) for new text end a second deleted text begin or subsequent time must paydeleted text end new text begin offense, new text end a fine of deleted text begin $225deleted text end new text begin $350new text end , plus the
amount specified in the uniform fine schedule established by the Judicial Councildeleted text begin .deleted text end new text begin ; and

(3) for a third or subsequent offense, a fine of $700, plus the amount specified in the
uniform fine schedule established by the Judicial Council.

(c) If an individual causes a collision that results in substantial bodily harm, as defined
in section 609.02, subdivision 7a, or the death of another, as a result of violating paragraph
(a), the individual is subject to the fine authorized in paragraph (b) multiplied by two.
