A bill for an act
relating to transportation; increasing fine for using a wireless communications
device while driving; amending Minnesota Statutes 2018, section 169.475,
subdivision 2.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 169.475, subdivision 2, is amended to read:


Subd. 2.

Prohibition on use; penalty.

(a) No A person may operate operating a motor
vehicle while is prohibited from using a wireless communications device to compose, read,
or send an electronic message, when the vehicle is in motion or a part of traffic.

(b) A person who violates paragraph (a) is subject to the following fines:

(1) for a first offense, a fine of $175, plus the amount specified in the uniform fine
schedule established by the Judicial Council;

(2) for a second or subsequent time must pay offense, a fine of $225 $350, plus the
amount specified in the uniform fine schedule established by the Judicial Council.; and

(3) for a third or subsequent offense, a fine of $700, plus the amount specified in the
uniform fine schedule established by the Judicial Council.

(c) If an individual causes a collision that results in substantial bodily harm, as defined
in section 609.02, subdivision 7a, or the death of another, as a result of violating paragraph
(a), the individual is subject to the fine authorized in paragraph (b) multiplied by two.
