  1.1                          A bill for an act 
  1.2             relating to education; allowing school districts to 
  1.3             dispose of surplus school computers; amending 
  1.4             Minnesota Statutes 1998, section 123B.52, by adding a 
  1.5             subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 123B.52, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 6.  [DISPOSING OF SURPLUS SCHOOL COMPUTERS.] (a) 
  1.10  Notwithstanding section 471.345, other provisions of this 
  1.11  section or other law to the contrary, a school district under 
  1.12  this subdivision may dispose of a school computer and related 
  1.13  equipment if: 
  1.14     (1) the school has used the computer and related equipment 
  1.15  for at least three school years; 
  1.16     (2) the district purchased the computer and related 
  1.17  equipment in whole or in part with state or federal funds; and 
  1.18     (3) the district does not need the property for its 
  1.19  intended purpose. 
  1.20     (b) The district must request disposition instructions from 
  1.21  the commissioner and may include in the request a recommendation 
  1.22  for a specific disposition of the property.  The district may 
  1.23  recommend to the commissioner that the property be conveyed to 
  1.24  another school district or to a student enrolled in the district 
  1.25  whose total family income meets the federal definition of 
  2.1   poverty. If the commissioner fails to provide disposition 
  2.2   instructions within 120 days of the date the district submits 
  2.3   the request to the commissioner, the district must dispose of 
  2.4   the property by conveying the property and title to another 
  2.5   school district or to the family of a student enrolled in the 
  2.6   district whose total family income meets the federal definition 
  2.7   of poverty. 
  2.8      (c) A district wishing to dispose of school computers and 
  2.9   related equipment under this subdivision must maintain an 
  2.10  inventory of such property and must reconcile the results of its 
  2.11  inventory with related property records at least once every two 
  2.12  years to verify the existence, current use, and continued need 
  2.13  for the property.  The district must maintain property records 
  2.14  for at least three school years after finally disposing of the 
  2.15  property.  The commissioner, or an authorized representative of 
  2.16  the commissioner, has access to these property records for 
  2.17  purposes of examining the records. 
  2.18     (d) A school district that uses federal funds in whole or 
  2.19  in part to purchase school computers and related equipment must 
  2.20  comply with applicable federal law governing the standards and 
  2.21  procedures that regulate the ownership, use and disposition of 
  2.22  such property. 
  2.23     Sec. 2.  [EFFECTIVE DATE.] 
  2.24     Section 1 is effective the day following final enactment.
