1.1 A bill for an act 1.2 relating to education; addressing certain food service 1.3 provisions; amending Minnesota Statutes 1998, section 1.4 124D.111, subdivision 1; Laws 1999, chapter 241, 1.5 article 7, section 2, subdivisions 2 and 5; repealing 1.6 Minnesota Statutes 1999 Supplement, section 124D.1155, 1.7 subdivision 5. 1.8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.9 Section 1. Minnesota Statutes 1998, section 124D.111, 1.10 subdivision 1, is amended to read: 1.11 Subdivision 1. [SCHOOL LUNCH AID COMPUTATION.] Each school 1.12 year, the state must pay districts participating in the national 1.13 school lunch program the amount of6.58 cents for each full 1.14 paid, reduced, and free student lunch served to students in the 1.15 district. 1.16 Sec. 2. Laws 1999, chapter 241, article 7, section 2, 1.17 subdivision 2, is amended to read: 1.18 Subd. 2. [SCHOOL LUNCH AID.] (a) For school lunch aid 1.19 according to Minnesota Statutes, section 124D.111, and Code of 1.20 Federal Regulations, title 7, section 210.17, and for school 1.21 milk aid according to Minnesota Statutes, section 124D.118: 1.22 $8,200,000 ..... 2000 1.23 $8,200,000 ..... 2001 1.24 (b) Any unexpended balance remaining from the 1.25 appropriations in this subdivision shall be prorated among 1.26 participating schools based on the number of free, reduced, and 2.1 fully paid federally reimbursable student lunches served during 2.2 that school year. 2.3 (c)If the appropriation amount attributable to either year2.4is insufficient, the rate of payment for each fully paid student2.5lunch shall be reduced and the aid for that year shall be2.6prorated among participating schools so as not to exceed the2.7total authorized appropriation for that year.2.8(d)Not more than $800,000 of the amount appropriated each 2.9 year may be used for school milk aid. 2.10 Sec. 3. Laws 1999, chapter 241, article 7, section 2, 2.11 subdivision 5, is amended to read: 2.12 Subd. 5. [SCHOOL BREAKFAST.] To operate the school 2.13 breakfast program according to Minnesota Statutes, sections 2.14 124D.115 and 124D.117: 2.15$456,000$713,000 ..... 2000 2.16$456,000$713,000 ..... 2001 2.17If the appropriation amount attributable to either year is2.18insufficient, the rate of payment for each fully paid student2.19breakfast shall be reduced and the aid for that year shall be2.20prorated among participating schools so as not to exceed the2.21total authorized appropriation for that year.Any unexpended 2.22 balance remaining shall be used to subsidize the payments made 2.23 for school lunch aid per Minnesota Statutes, section 124D.111. 2.24 Up to one percent of the program funding can be used by the 2.25 department of children, families, and learning for technical and 2.26 administrative assistance. 2.27 Sec. 4. [REPEALER.] 2.28 Minnesota Statutes 1999 Supplement, section 124D.1155, 2.29 subdivision 5, is repealed. 2.30 Sec. 5. [EFFECTIVE DATE.] 2.31 Sections 1 to 4 are effective the day following final 2.32 enactment.
