  1.1                          A bill for an act 
  1.2             relating to state lands; modifying authority of the 
  1.3             metropolitan mosquito control commission over lands 
  1.4             administered by the commissioner of natural resources; 
  1.5             amending Minnesota Statutes 1998, section 473.704, 
  1.6             subdivision 17. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 473.704, 
  1.9   subdivision 17, is amended to read: 
  1.10     Subd. 17.  [ENTRY TO PROPERTY.] Members of the commission, 
  1.11  its officers, and employees, while on the business of the 
  1.12  commission, may enter upon any property within or outside the 
  1.13  district at reasonable times to determine the need for control 
  1.14  programs.  They may take all necessary and proper steps for the 
  1.15  control programs on property within the district as the director 
  1.16  of the commission may designate.  Subject to the paramount 
  1.17  control of the county and state authorities, commission members 
  1.18  and officers and employees of the commission may enter upon any 
  1.19  property and clean up any stagnant pool of water, the shores of 
  1.20  lakes and streams, and other breeding places for mosquitoes 
  1.21  within the district.  The commissioner of natural 
  1.22  resources shall may allow the commission to enter upon state 
  1.23  property for the purposes described in this subdivision, but has 
  1.24  the authority to approve or disallow any insecticide application 
  1.25  by the commission.  On land not under the authority of the 
  1.26  commissioner of natural resources, the commission may apply 
  2.1   insecticides approved by the director to any area within or 
  2.2   outside the district that is found to be a breeding place for 
  2.3   mosquitoes.  The commission shall give reasonable notification 
  2.4   to the governing body of the local unit of government prior to 
  2.5   applying insecticides outside of the district on land located 
  2.6   within the jurisdiction of the local unit of government.  The 
  2.7   commission shall not enter upon private property if the owner 
  2.8   objects except for control of disease bearing mosquito 
  2.9   encephalitis outbreaks.
