A bill for an act
relating to education; requiring school districts and charter schools to allow
certain pupils with a disability who have not completed the special instruction
and services to attend their high school graduation ceremonies; amending
Minnesota Statutes 2006, section 125A.04.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 125A.04, is amended to read:


125A.04 HIGH SCHOOL DIPLOMAnew text begin ; GRADUATION CEREMONYnew text end .

new text begin (a) new text end Upon completion of secondary school or the equivalent, a pupil with a disability
who satisfactorily attains the objectives in the pupil's individual education plan must be
granted a high school diploma that is identical to the diploma granted to a pupil without a
disability.

new text begin (b) A school district or charter school must allow a pupil with a disability, whose
individual education plan prescribes continued special instruction and services beyond the
fourth year of high school, to participate fully in school sponsored and directed graduation
ceremonies and activities with the pupil's graduating class. The pupil shall receive a
certificate of attendance at the graduation ceremony, provided that the pupil has met all of
the school's nonacademic standards for students to be eligible to participate in graduation
ceremonies regardless of whether the pupil has completed the special instruction and
services in the pupil's individual education plan. Nothing in this paragraph precludes a
pupil with a disability from receiving a high school diploma under paragraph (a).
