  1.1                          A bill for an act 
  1.2             relating to agriculture; requiring the commissioner of 
  1.3             agriculture to stop payments to ethanol plants found 
  1.4             by cities to be nuisances; amending Minnesota Statutes 
  1.5             2000, section 41A.09, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 41A.09, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 9.  [ETHANOL PLANT NUISANCES.] If an ethanol plant is 
  1.10  located in a city and has been found to be a nuisance under a 
  1.11  city ordinance, the commissioner of agriculture must not make 
  1.12  payments to the producer under this section for any production 
  1.13  during the time the plant remains a nuisance.  The commissioner 
  1.14  must start making payments again as soon as the city has 
  1.15  confirmed that the plant is no longer a nuisance under the 
  1.16  city's ordinance. 
  1.17     Sec. 2.  [EFFECTIVE DATE.] 
  1.18     This act is effective the day following final enactment.
