A bill for an act
relating to health and human services; establishing the Minnesota health care
programs special revenue fund; proposing coding for new law in Minnesota
Statutes, chapter 256.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin For the purposes of this section, "Minnesota health care
programs" means publicly funded health care programs administered by the commissioner
of human services under chapters 256B, 256L, 256R, and 256S, and the Minnesota restricted
recipients program.

new text begin The Minnesota health care programs special revenue fund is
created as a special revenue fund in the state treasury to provide an additional source of
public money for initiatives relating to Minnesota health care programs. The commissioner
of human services may expend money appropriated from the Minnesota health care programs
special revenue fund only for purposes specified in law.

new text begin The state share of all money recovered by the commissioner of human
services under the following sections that are not otherwise apportioned for a specific
purpose in Minnesota Statutes must be deposited in the Minnesota health care programs
special revenue fund:

new text begin (1) reimbursement from workers' compensation insurers under section 176.191,
subdivision 4;
new text end

new text begin (2) payments to satisfy a public assistance lien under section 256.015;
new text end

new text begin (3) payments from third parties under section 256B.042;
new text end

new text begin (4) payments from trusts under section 256B.056, subdivision 3b;
new text end

new text begin (5) third-party payments under section 256B.056, subdivision 6;
new text end

new text begin (6) payments received as a preferred remainder beneficiary under section 256B.056,
subdivision 11;
new text end

new text begin (7) medical assistance recoveries under section 256B.15;
new text end

new text begin (8) distributions from ABLE accounts under section 256Q.08, subdivision 2;

new text begin (9) payments to satisfy a medical assistance lien under sections 514.980 to 514.985; and
new text end

new text begin (10) interest accrued on money in the fund.
