1.1 A bill for an act 1.2 relating to elections; nominating petitions; allowing 1.3 a candidate who files for partisan office by 1.4 nominating petition to include in the candidate's 1.5 political party or principle a part of the name of a 1.6 major political party; amending Minnesota Statutes 1.7 1998, section 204B.07, subdivision 1. 1.8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.9 Section 1. Minnesota Statutes 1998, section 204B.07, 1.10 subdivision 1, is amended to read: 1.11 Subdivision 1. [FORM OF PETITION.] A nominating petition 1.12 may consist of one or more separate pages each of which shall 1.13 state: 1.14 (a) The office sought; 1.15 (b) The candidate's name and residence address, including 1.16 street and number if any; and 1.17 (c) The candidate's political party or political principle 1.18 expressed in not more than three words. No candidate who files 1.19 for a partisan office by nominating petition shall use the term 1.20 "nonpartisan" as a statement of political principle or the name 1.21 of the candidate's political party.No part of the name of a1.22major political party may be used to designate the political1.23party or principle of a candidate who files for a partisan1.24office by nominating petition, except that the word1.25"independent" may be used to designate the party or1.26principle.The name of a major political party must not be used 2.1 to designate the political party or principle of a candidate who 2.2 files for a partisan office by nominating petition, but a part 2.3 of the name of a major political party may be used in 2.4 designating the political party or principle of such a 2.5 candidate. A candidate who files by nominating petition to fill 2.6 a vacancy in nomination for a nonpartisan office pursuant to 2.7 section 204B.13, shall not state any political principle or the 2.8 name of any political party on the petition.
